1. Non-Refundable And Non-Transferable
All money paid is non-refundable and non-transferable for whatsoever reason thereafter
2. As Is Where Is Basis
The property is rented in an "as is where is basis". No further additional items will be provided
3. Strictly Not Allowed
No Smoking (indoors), No Pets, No Parties / No Events
4. True Identity Of Tenant And All Occupants Which Will Be Tenanting Together
The Tenant is to disclose and furnish true information of identities of the Tenant and all other occupants who are tenanting together in the premise. Any unauthorised occupant shall cause the agreement to be null and void and is considered as breach of agreement and the Landlord reserves the rights to terminate the agreement, forfeit all the deposits and evict the Tenant and all the occupants and their belongings with immediate effect without any given notice.
5. Maximum Occupancy
The Maximum Occupancy for each of the apartments are as stated. Rental rates are charged according to the maximum occupancy stated. Any unauthorised occupant shall cause the agreement to be null and void and is considered as breach of agreement and the Landlord reserves the rights to terminate the agreement, forfeit all the deposits and evict the Tenant and all the occupants and their belongings with immediate effect without any given notice.
6. No Subletting
The Tenant shall not sublet any or all the Property without the prior written consent of Landlord. Any subletting shall cause the agreement to be null and void and is considered as breach of agreement and the Landlord reserves the rights to terminate the agreement, forfeit all the deposits and evict the Tenant and all the occupants and their belongings with immediate effect without any given notice.
7. Warranty Period
The warranty period provided is for one (1) week. After the warranty period is over, the Landlord shall not be liable to make any repairs necessitated. The Tenant is to bear the cost for all repairs, replacement required to maintain the property and the inventory by themselves. At the end of the tenancy, the Tenant is expected to surrender and handover the property and all the inventory back to the Landlord in good working condition.The Landlord reserves the rights to forfeit the deposits or demand additional payment (if the deposits are insufficient) from the Tenant for any loss or damages to restore and recover the property to its original condition or a condition which is satisfactory to the Landlord
8. Loss Or Damages
The Tenant is liable for any loss or damages to the property and the inventory. At the end of the tenancy, the Tenant is expected to surrender and handover the property and all the inventory back to the Landlord in good working condition.The Landlord reserves the rights to forfeit the deposits or demand additional payment (if the deposits are insufficient) from the Tenant for any loss or damages to restore and recover the property to its original condition or a condition which is satisfactory to the Landlord
9. Monthly Rental To Be Paid On The Date Stipulated No Later Than 7 Days Even On Unforseeable Events Or Pandemic
The Tenant is required to pay the monthly rent in advance for the coming month on the date as stipulated on the agreement and not later that 7 days and to send copies of proof of payment to the Landlord. The Tenant is also obliged to continually pay the monthly rental even in the event of unforseeable event or circumstances such as pandemic, diseases, global health emergency or lockout, Covid-19, economic crisis etc. Any unpaid rent after the 7th day is considered as breach of agreement and the Landlord reserves the rights to terminate the agreement, forfeit all the deposits and evict the Tenant and all the occupants and their belongings with immediate effect without any given notice
10. Duration Of Tenancy, Early Termination And Consequences
The Tenant is required to continuously pay the monthly rent up to the last day of tenancy according to the agreed tenancy period which is as stipulated by the tenancy agreement. Any early termination or failure to pay the montly rent is considered as breach of agreement and the Landlord reserves the rights to terminate the agreement, forfeit all the deposits and evict the Tenant and all the occupants and their belongings with immediate effect without any given notice
11. Deposits Not Allowed To Offset The Rental
The Tenant is required to continuously pay the monthly rent up to the last day of tenancy according to the agreed tenancy period which is as stipulated by the tenancy agreement and the deposits are not allowed to be used to offeset the rental. All deposits shall not in any event be treated as rent, service charge, set-off or treated as payment towards any arrears of payment due from the Tenant to the Landlord. The deposits paid shall be applied as security to the Landlord in the event of any breach or non compliance by the Tenant of the terms and conditions herein contained
12. Utility Bills (Electricity Bills, Water Bills, Indah Water Bills, Etc)
The Tenant is required to fully settle all Utility Bills up to date and to send copies of the paid Utility Bill to the Landlord at monthly basis
13. To Abide To The Rules & Regulations Of The Condo Management
The Tenant is to abide to the rules and regulations that are currently applicable and also those that shall be implemented at a later stage. The Handbook can be obtained from the condo management office
14. Upon The Completion Or Fulfillment Of This Agreement
a) Two (2) Months Advance Notice
The Tenant must inform the Landlord of their intention to move out in writing at least Two (2) months advanced notice
b) Expectations Upon Surrender And Handover Of The Premise
The Tenant is expected to surrender and handover the premise in a neat, clean and good condition with all bills paid up to date
c) Deposits
Deposits shall be refunded to the Tenant by the Landlord upon fulfilling the tenancy agreement without interest within fourteen (14) working days from the date of surrender or handover subject to a damage inspection of the premise less the following:
(i) any outstanding monies due to the Landlord by the Tenant pursuant to this Tenancy for damages to the property or the inventory or by reason of any breach or non-compliance of the terms and conditions herein, and/or
(ii) any outstanding monies due to by the Tenant to the proper authorities in respect of fines, penalties and/or deposits and/or charges for water, gas, electricity, telephone, fax and any other utilities consumed on the Demised Premise
d) Forfeiture Of Deposits, Demanding Additional Payment For Cleaning Fee, Losses, Damages, Restoring The Property
The Landlord reserve the rights to forfeit the deposits or demand additional payment from the Tenant (if the deposits are insufficient) for cleaning fee, losses, repairs, re-painting, damages to restore and recover the property to its original condition or to the condition which is satisfactory to the Landlord
15. All other terms are as stated in the tenancy agreement
